CUSTOMERS REQUEST TO AFFORD REFUND DUE TO THE WORST AND SLOWEST PROGRESS OF THE EARTH INFRA STRUCTURE PVT. LTD, IN NOIDA WEAT PROJECTS.
The performance of the Earth Infra structure Pvt. Ltd. the Project
named-Earth Towne of flats and also The Earth Sapphire of office spaces is the
worst among all the projects of all the builders of the country. The projects were
started / launched in the year 2010-11. The builder was supposed to have given
possession of the flats and office spaces after 30 months, extendable by 6
months. More than six years are over, but even the work has not started in some
of the blocks of the project Earth Towne, where as progress of Earth Sapphire
that of snail’s pace. The buyers, who had booked their properties and many of
them who had made down payments, are the worst sufferers and lost patience
because of inordinate delay. From the past pace of progress, it seems that the
builders will still take another 4-5 years in completing the project and giving
possession of the properties. The Earth Infra structure Pvt. Ltd. are the only one such builders of the country,
who do not care / listen the problems of their customers, do not give theirs
phone/mob no. to the valued customers, and do not talk or even meet any of them.
The customers are totally helpless, disgusted and disappointed of the behaviour
of the builders and progress / performance of their projects. Now, it is high
time that all the customers of the project must come together to find the
solution of this grave situation. In this regard, I strongly feel that there is
one and only one solution of the problem and that is to approach the courts and
appeal for the following:
i.
Afford
the refunds of all the properties i.e. that of flats booked in Earth Towne and office spaces booked
in Earth Sapphire as per present sale prices of the flats and office spaces as
have now been presently re-fixed by the Earth Infrastructure Pvt. Ltd. Earth
Towne and Earth Sapphire, or as per the prevailing market rate or as is being
the present rate of other builders of their old unsold/completed projects which
has to be mutually decided between the builders and buyers, but buyers proposal
has to be accepted by the builders.
ii.
Pay
the interest on the entire amounts, whatever the customers have paid so far of their
flats and office spaces @ 24 % per annum of all their properties that are being
cancelled by the customers or @ as the same is normally charged by the
Earth Infra structure Pvt. Ltd. and
other builders for delayed payments.
iii.
Pay
the penalty as per normal/prevailing norms, but not less than @12 % or as to be
decided by the judiciary, if Earth Infrastructure Pvt. Ltd. Towne and Sapphire do
not agree to the proposal.
iv.
Pay
the entire amounts that of withheld cheques of the offices booked/allotted in
Earth Sapphire from the period the builders have with held/stopped giving the
post-dated cheques till the period the refunds are afforded.

CHANCES OF IMPLEMENTATION OF OROP IN INDIA ESPECIALLY WITH THE BJP GOVT.
The present Govt. and the bureaucrats are the worst enemy of
the veterans and serving Defence personnel. Rather, they are dumb and deaf. It is
futile for veterans, it is like striking their heads against concrete wall, and
they will break their own head, the Modi Govt. will never move, yet, there is
no alternative other than the peaceful method as is being followed now. The Govt.
and all politicians care for themselves only, they raise their own pay and
allowance many folds as they want and when they want just with raising hands in
the Parliament house, inspite of their qualification may be nil, whereas, they
pay and allowances for Govt. employees, it can never be done before ten years
that too it takes two to three years in taking decision after Govt. set CPC.
Even the President of India who is the supreme commander of the Defence forces
is in competent to do anything in the matter as firstly nothing is in hands, secondly;
he too is one of the politicians. What to talk surrendering medals to the President
of India or to the Govt. even if the veterans or anyone from public give their
head to them, even then they are not moved. Well this system of functioning of
the country and the veterans and the entire public has to suffer forever
unless, such a system happen to ever change.

NON-IMPLIMETATION OF OROP.
In fact, it is the PM, who is sole authority to do the
needful, though, the Defence Minister must exert his pressure on the PM, but he
too will never do it; however sweet he may seems to be. Hence, it is the PM alone
who is to be blamed. The next culprit in this case is the finance minister,
who, heart of heart is not at all in support of the ex-servicemen, whatever, he
may say. Nevertheless, the main hurdle in the case of all serving and
ex-servicemen are the bureaucrats, who have never been in support of anyone in
general Defence personnel in particular; except of their own cadre, where as no
one ever has dared to oppose them. Whatever the case may be, it is the PM alone,
who does not have any say in such matter, though, he may be strong enough
within the Party.
In view of such an indifferent attitude of BJP Govt., the
ex-service personnel must boycott all functions and rallies of all politicians
of BJP, the PM and its all ministers of center and Chief Minister and other
ministers of states, MsP, and MsLA, who-so-ever they may be(including any
functions of Defence personnel that are organised by the Govt. or its
functionaries). This should be done even in the cases of president of India and
Governors states Governments, so that they may advise and put some pressure on
the PM.
The ex-servicemen must draw a deadline to get their demand
fulfilled within the stipulated time, unless the Govt. gives such a time. In case,
such a situation remains beyond the deadline, all the serving and retired Defence
personnel must take a vow, never to vote for the BJP. This decision should be communicated
to them well in advance.
However, it is not advisable to say that the serving
personnel also do the same what the ex-service men are panning, as, in such a
case national security may be jeopardized and will be at stake and the country
as a whole will be disgraced and defamed in the world for such events in the
country.
Nevertheless, all the three chiefs of the three wings of Defence
forces must exert pressure on the PM, Defence Minister and the Govt. In case the Govt. still
does not budge and fails to full the promise the Party as a whole has made before
the elections, they should resign as they have achieved the highest rank and
must not expect anything more and must ensure the welfare of the Defence forces.
This cannot be considered the indiscipline as it is in the best interest of
their men.
I wish to say that people are forced to frustrate by the
external forces. In the instance case the BJP Govt. has forced to frustrate the
ex-service veterans by not to implement the OROP in spite of previous Govt. has
approved and announced in Parliament, BJP before general election announce
emphatically to implement, announce by the President of India in joint session of
parliament, announced by the PM from the red forte and repeatedly announce by
the PM in various forums. The BJP Govt. has made the OROP a joke, playing with
the sentiments of veterans and has been insulting them since it came to power. Since,
I am also one of the veterans, I am also very much frustrated and I am forced
to write my “MAN KI BAAT” yet, I apologise for the same being a discipline
soldier.

What sort of some unscrupulous people can be in our country with
negative thinking and negative planning with negative intelligence is rather, unimaginable!
No name, but bad luck of the country.
The OROP has been delayed by the authorities, I do not want
to name them, the Governments or the bureaucrats or both, they know very well. Earlier
the Congress Party governments in connivance of bureaucrats were delaying the implementation
of OROP and all other parties including BJP were cursing the congress Governments
for not implementing the OROP. Now, since the BJP is in power, the Congress Party
along with others is beating the same kind of drums, and it is not certain how
long it will continue?
One of the stunts; some time back it was in the news that
the paramilitary personnel too want to get the OROP for their retired
personnel. The Defence force are not against any of such demands of any
organisation, but before that, they must peep into their sole and see if all the
service conditions that are prescribed for Defence force personnel are
applicable for them. If not, how and why anyone should jump into the fray?
However, it is felt that it is not the paramilitary
personnel, who could have projected such unjustified demands, but it is the
bureaucracy, which keep trying to put pokes and hurdles after hurdles. It is
not understood why the bureaucracy of the country always has been against the Defence
forces of the country, where as the Defence forces still and always give them
their due.
Now, the PM, his ministers and the chief advisers, the
bureaucrats, who always try to remain behind the scene, have started another
stunt saying that the Govt. is thinking and planning to increase the pension of
Defence forces personnel according to the norms as are being adopted for the Members
of Parliament. What a great thinking and stunt it is? It is something like bolt
from the blue for the Defence forces personnel. Rather, some unscrupulous people
are trying to find ways to delay the OROP for an indefinite period. Now, this
will take another 30-40 years and that is what the PM wants as he has mentioned
about the previous Govts.
It seems to be more than clear the ingenuine intention,
planning and thinking of the Govt. so, it should be more than clear for all the
Defence forces personnel, serving or retired. The chief of staff of any of the
wings of Defence forces cannot afford to take the stand strongly, because they
are bound by the norms of the uniforms they are wearing and that is essential
too, but in addition, they also keep dreaming to become Governors or something
like it to get/hold elite posts after their retirement. Hence, one/some of the
retired solders have to take lead and that is what is being done until date.
In addition, we the soldiers always have believed, still
believe and will continue believing forever in the law of the land, which
always has been unbiased to all the citizens of the country including Defence forces
personnel. The point to note that the Apex court of the country had given deadline
to the present Govt. to implement the OROP within three months, the PM feels and
is so strong that he or his Govt. did not care for the deadline and the matter
is still hanging in the wilderness.
Now, what the IESM is doing, it should continue without getting
roped in the false promises of the Defence Minister or that of anyone. In addition, the
IESM should go to the Apex court for getting the justice. The IESM should also advise
all the states ex-servicemen associations to approach their High courts to seek
justice for them.
The Govt. of India must appreciate and realize that denial
and not implementing the OROP adversely affects the morale of serving Defence forces
as they are clearly foreseeing their future as many of them are to retire
tomorrow and subsequently. God forbid if war happens to be imminent tomorrow,
how adversely the morale of the Defence fighting forces will affect, no one can
predict.

This is
with reference to editorial in Times of India of 1 Jun, where it is mentioned
to give OROP but reduce the flab of Army. It seems something like bargaining
against the national security. Any way it is writer’s perception and level of
wisdom/thinking or he may have been given wrong feedback by some ignorant or
disgruntled person.
In this
context, it is felt essential to ask and advise the writer of his blog in Times
of India of 1 Jun 2015 that though the suggestion seems to be logical his point
of view, but what does he know about army. It is most important for him and
every citizen of India that each and every Defence forces personnel is meant to
fight against the enemy, safe guard the national boarders and ensure national
security. There is nothing like orderly or escorts in the Defence forces, what
the writer has perceived. Everyone in the Defence forces is a soldier first. They
may be combatants, or non-combatants, whatever rank they may be wearing, may
they be other ranks, JCOs or officers holding any ranks. May anyone in the
Defence forces is general duty soldier, or tradesmen like clerks, drivers,
cooks, washer men or any other tradesmen. The sole purpose in the Defence
forces is one and one only and that is to do the duties assigned to them at all
costs; even at the cost of their lives, irrespective of any adverse conditions
or terrain, may it be day or night, thus remaining vigilant for 24 hours at all
times. And, that duty for each and every Defence forces personnel is to fight
against the enemy, safe guard the national boarders and ensure national
security. Though, in addition to their primary duty, they are used or mis-used
in engaging/deploying in helping the people and nation in checking and
controlling any type of national calamities.
As
mentioned above, the Defence forces are meant to fulfill their role assigned to
them, of course their capability to discharge their role depends on many
factors, out of which some of them depend on the National Govt., i.e. providing
adequate manpower, required arms, ammunition, and equipments, depending on the
size of its borders, terrain, and strength of enemy forces.
If the
writer suggests and Govt. thinks essential to reduce the strength of Defence
forces, irrespective of implementing OROP or not, they may do so, that may
prove suicidal for the nation, in which case the Defence forces cannot and will
not be held responsible. However, it is the primary duty of the Defence forces
to project their adequate requirement as is needed and considered essential to
meet the challenges at all times.
